Nutex has found a way around this by structuring its facilities as separate entities, often not subject to the same federal mandates.

The investigation found that patients with serious conditions, including heart attacks and strokes, have been turned away or transferred to other hospitals after being told their insurance was not accepted. In some cases, patients were billed for thousands of dollars for simply walking in the door, even if they received no treatment. Nutex has also been accused of aggressive billing practices, sending patients to collections for small amounts.

The company's financial records show it has been highly profitable, with executives earning millions in compensation. Critics argue that Nutex is prioritizing profit over patient care, using legal technicalities to avoid the obligations that traditional hospitals must follow. The findings raise serious questions about the regulation of freestanding ERs and whether current laws are adequate to protect patients from being denied emergency care based on their financial status.
